1. company identification

Pyroca Inc. , a company registered and located in Saint-Constant, Quebec, Canada , operates the website www.pyroca.com . All correspondence can be sent to the following email address: info@pyroca.com .

These General Terms and Conditions define the rights and obligations of the parties in the context of the online sale of products offered by Pyroca Inc.

2. scope

These Terms and Conditions apply to all orders placed on the website www.pyroca.com by individual or professional customers (hereinafter referred to as "the customer"). They supersede any other document or communication, unless expressly agreed to in writing by Pyroca Inc.

By validating their order, the customer declares that they have read the Terms and Conditions and accept them fully and without reservation.

Products sold:

Patio heater: available in standard and customized versions.
Related accessories: protective gear, maintenance tools, spare parts.
Portable barbecues
Related accessories: carrying case, protective mat

Availability :

The products are available:

In stock: fast delivery subject to availability.
Made to order: for specific customizations or in case of stock shortage. Production times will be communicated to the customer.

Instructions for use and safety:

Each product comes with detailed instructions including:

Installation and usage instructions.
Maintenance and safety measures. The customer agrees to read and comply with these instructions. Pyroca accepts no liability in case of non-compliance.

4. price

The prices displayed on the site are in Canadian dollars (CAD) and do not include applicable taxes (GST, QST).
Delivery charges are calculated and added to the total amount when the order is confirmed.
Pyroca Inc. reserves the right to change its prices at any time. However, the prices applied will be those in effect at the time of the order.

Secure payments:

All transactions are conducted via secure platforms that comply with international standards. Pyroca Inc. does not store any banking information.

6. orders and modifications

Ordering process:

The customer validates their order via the website www.pyroca.com by following the indicated steps.
An order confirmation is sent by email after payment has been validated.

International orders:

Orders outside of Canada require a custom quote for shipping costs.
Pyroca reserves the right to refuse any non-compliant order.

Modification or cancellation:

Orders can only be modified or cancelled before they are shipped.
Once the package has been picked up by the carrier, no changes or cancellations will be possible.

7. delivery

Introductory note: The specific shipping rates and thresholds that apply are those indicated on our website and confirmed at the time of payment. This policy describes the general terms and conditions of their application.

Article 1: Order Processing

All orders are processed within 2 to 3 business days (excluding weekends and public holidays) after receipt of your order confirmation email. You will receive an additional notification when your order has been shipped.

Article 2: Partner Carriers

Pyroca collaborates with reputable carriers to ensure reliable and efficient delivery. Our main partners include, but are not limited to: Canada Post, UPS, GLS, DHL, and FedEx.

Article 3: Delivery Zones

Canada: We offer standard delivery to all Canadian provinces and territories. Our terms may vary for areas considered remote by our carriers, and this will be reflected in the options presented at checkout. Remote areas include:
- Northwest Territories (NWT),
- Nunavut (NU),
- Yukon (YT).
International: International shipping is available by quote only. Please contact us directly for any shipping requests outside of Canada.

Article 4: Shipping Methods and Rates

Our store uses two pricing systems for shipping, depending on the products ordered.

4.1 Fixed Rate Shipping (for the patio heater)

The patio heater is subject to fixed shipping rates that vary depending on the delivery zone. These rates are calculated and displayed at checkout. This product is not eligible for standard free shipping offers.

4.2 Standard and Conditional Free Shipping (for all other products)

All other products, including the barbecue, the glass tube, and all our accessories, follow the same rule:
Standard delivery may be offered for orders exceeding a value threshold communicated on our website.
For orders not reaching this threshold, a standard fixed price applies.

4.3 Mixed Orders

In the case of a mixed order, shipping costs are calculated by adding the rate applicable to the patio heater and the rate applicable to the rest of the basket, according to the rules above.

Article 5: Estimated Delivery Times

The following times are estimates in working days and begin from the date of shipment.

Standard Delivery: 7 to 10 business days.
Express Delivery: 3 to 5 business days.

Pyroca cannot be held responsible for delays attributable to the carrier.

Article 6: Order Tracking

As soon as your order is shipped, you will receive an email with a tracking number. Please note that some products, such as patio heaters, may be shipped in multiple packages that could arrive on different dates.

Article 7: Receipt and Responsibility

Once the package is picked up by the carrier, responsibility for its delivery is transferred to the carrier. Pyroca cannot be held liable for any delays, losses, or damages that occur during transport.

It is the customer's responsibility to check the condition of the package upon receipt. In the event of any visible damage to the packaging or the product, the customer must immediately report it to the delivery driver and contact our customer service department within 48 hours, providing supporting photos so that we can file a claim with the carrier.

Article 8: Delivery Addresses

The customer is responsible for providing a complete and accurate delivery address. If the package is returned due to an incorrect or incomplete address, or if the package is not claimed, the customer will be responsible for the reshipping costs.

8. return policy and warranty

1. Returns & Right of Withdrawal

You have 30 days from delivery to request a return of a product.

Only unused, complete products in new condition and in original packaging will be accepted.

Any product that is incomplete, used, damaged, or returned without its original packaging cannot be accepted for return or refund.

Return shipping costs are the responsibility of the customer, except in the case of a defect covered by the warranty.

2. PYROCA Warranty

The warranty applies only to the following models:

Barbecue
Patio heater

The warranty covers exclusively metal structures for a period of 1 year from the date of delivery.

The following are not covered by the warranty:

The glass tube , the combustion grate and all parts considered fragile or consumable.
Accessories and additional parts.
Aesthetic damage: scratches, discoloration, normal wear and tear of the paint or coating .

The following are excluded from the warranty:

Damage due to misuse, improper storage or incorrect assembly .
The use of unsuitable fuels.
Any modification or repair carried out by a third party not authorized by PYROCA.

3. Return or Claim Process

Contact our customer service department by email at info@pyroca.com , specifying:

Your order number
A precise description of the problem
Photos or videos if necessary

After analysis, PYROCA will propose a suitable solution :

Product repair
Replacement of the defective part or product
Refund (partial or full, as applicable)

No returns will be accepted without prior agreement and a return number assigned by PYROCA.

9. "pyroca+ club" membership program

Objet de l'adhésion:

Le "Club Pyroca+" est un programme d'adhésion payant offrant aux clients (ci-après "le Membre") l'accès à des avantages et services exclusifs, tels que détaillés sur la page de vente du produit "Club Pyroca+" et dans le présent article. L'adhésion est formalisée par la souscription à un abonnement.

Les Formules d'Abonnement:

Le Club Pyroca+ est disponible sous deux (2) formules, au choix du Membre lors de la souscription :

Abonnement Mensuel : Engagement pour une période d'un (1) mois, renouvelable tacitement.
Abonnement Annuel : Engagement pour une période de douze (12) mois, renouvelable tacitement.

Avantages des Membres:

L'adhésion active et ininterrompue au Club Pyroca+ donne droit aux avantages suivants :

a) Extension de Garantie : La garantie constructeur du chauffe-terrasse Pyroca du Membre est étendue pour toute la durée de son adhésion active. Cette garantie étendue couvre l'intégrité et la fonctionnalité de toutes les pièces structurelles métalliques contre les défauts de fabrication et les pannes.
Exclusions : Sont explicitement exclus de cette garantie étendue :

Les pièces d'usure et consommables, notamment le tube en verre et la grille de combustion.
Les dommages esthétiques, incluant mais ne se limitant pas aux éclats de peinture, à la décoloration, aux rayures ou à la rouille de surface résultant d'un usage normal, d'une exposition aux intempéries, d'impacts ou d'un entretien non conforme.
Tout dommage résultant d'un accident, d'un mauvais usage ou d'une modification non autorisée du produit.

b) Tarif Membre sur les Pièces Détachées : Le Membre bénéficie d'une réduction de cinquante pour cent (50%) sur le prix de vente affiché de toutes les pièces détachées disponibles sur le site pyroca.com.

Conditions d'éligibilité et Limitations :
i. Cet avantage est soumis à un délai de carence. Il est activé et devient accessible au Membre uniquement après une période minimale et ininterrompue de quatre (4) mois d'adhésion suivant la date de sa souscription initiale.

ii. Pour toutes les pièces détachées, à l'exception du tube en verre, cette réduction est applicable sans limite de quantité ni de fréquence.

iii. Pour le produit "Tube en verre de remplacement", l'application de cette réduction est limitée à une (1) unité par période de douze (12) mois consécutifs d'adhésion.

Modalités d'application : Pour bénéficier de cet avantage, le Membre éligible devra contacter le service client. Après vérification de l'éligibilité (ancienneté et historique d'utilisation pour le tube en verre), un code de réduction à usage unique ou permanent, selon le cas, lui sera fourni.

c) Réduction sur la Boutique : Le Membre bénéficie d'une réduction de quinze pour cent (15%) sur le prix de vente affiché de tous les produits disponibles sur le site pyroca.com, à l'exception des chauffe-terrasses complets. Pour bénéficier de cet avantage, le Membre doit être connecté à son compte client actif au moment de l'achat. La réduction sera appliquée automatiquement sur tous les produits éligibles dans le panier ou lors du processus de paiement (checkout). Cette réduction n'est pas cumulable avec d'autres promotions ou codes de réduction en cours, sauf mention contraire explicite.

d) Accès Prioritaire au Support : Les demandes du Membre (par e-mail ou tout autre moyen de contact fourni) seront traitées de manière prioritaire par notre équipe d'experts.

Prix et Modalités de Paiement:

Les tarifs des formules d'abonnement sont ceux indiqués en dollars canadiens (CAD) sur la page du produit "Club Pyroca+" au moment de la souscription. Le paiement s'effectue par prélèvement automatique sur le moyen de paiement renseigné par le Membre, selon la périodicité choisie (mensuelle ou annuelle). Le Membre s'engage à maintenir des informations de paiement valides pour assurer le renouvellement de son adhésion.

Durée, Renouvellement et Résiliation:

L'abonnement débute à la date de souscription pour la période initiale choisie (1 mois ou 12 mois).

Renouvellement : À l'échéance de la période initiale, l'abonnement est reconduit tacitement pour une période identique, sauf résiliation par le Membre.

Résiliation : Le Membre est libre de résilier son abonnement à tout moment et sans frais depuis son espace client sur le site pyroca.com. La résiliation prendra effet à la fin de la période de facturation en cours. Le Membre continuera de bénéficier de ses avantages jusqu'à cette date. Aucun remboursement au prorata ne sera effectué pour la période restante.

Cas Particulier des "Membres Fondateurs" (Période Gratuite):
Les clients bénéficiant d'une offre "Membre Fondateur" disposent d'une période d'adhésion gratuite de douze (12) mois.

Renouvellement : Pour garantir une continuité de service sans interruption, à l'issue de cette période gratuite, l'abonnement sera automatiquement renouvelé sur une base Annuelle au tarif préférentiel communiqué au Membre, sauf résiliation par le Membre avant la date anniversaire de sa souscription initiale.
Notification : Un e-mail de notification sera envoyé au Membre en amont de la date de renouvellement, lui rappelant la reconduction à venir et les modalités de résiliation.

Modification des Conditions:

La société Pyroca se réserve le droit de modifier les avantages, les tarifs ou les conditions du Club Pyroca+. En cas de modification substantielle, la société Pyroca informera le Membre par e-mail dans un délai raisonnable d'au moins trente (30) jours avant leur entrée en vigueur. Le Membre aura la possibilité de refuser les nouvelles conditions en résiliant son abonnement avant cette date.

Disclaimer:

Pyroca declines all responsibility in case of failure to comply with the instructions for use and safety.
The company is not liable for indirect damages, such as loss of business or revenue.

Limitation of liability:

In any event, Pyroca's liability is limited to the amount of the order.

11. intellectual property

Protection of rights:

Pyroca products, as well as their technology and design, are protected by registered patents and copyrights.
Pyroca is a registered trademark. Any unauthorized reproduction, modification or use is strictly prohibited.
